By Purchasing A Ticket to Any Retreat or In-Person Workshops, you irrevocably agree to the following Terms & Conditions:
EVENT TERMS AND CONDITIONS
“Event” means the event(s) or retreat(s) which You have bought a Ticket to attend with Documentary Family Photographers Worldwide Ltd. (DFP) and it's associated partners.
"Company" and “Us” means Documentary Family Photographers Worldwide Ltd. (DFP), including the company’s subsidiaries and its agents, contractors, sub-contractors, representatives, servants and employees.
“DFP" means Documentary Family Photographers Worldwide Ltd.
“Terms and Conditions” means these terms and conditions.
“Venue” means the site at which the Event takes place
“Ticket” means any valid ticket which permits You to attend each respective Event
“You” means you as the holder of the Ticket and “Your” shall be read accordingly.
1. Acceptance
1.1. Documentary Family Photographers Ireland Retreat is operated by Documentary Family Photographers Worldwide. These terms and conditions, together with the Retreat Description sales page the agreement between you and DFP. By booking a retreat ticket, you accept these terms and conditions.
1.2. To confirm your place at the retreat, a initial deposit must be made upon booking.
1.3. If the full amount of the retreat package price is not paid at least 3 weeks prior to the retreat start date, the place will be released and resold and the deposit will be forfeited.
1.4. Any bank fees incurred through transferring funds are the responsibility of the guest.
1.5. DFP does not offer discounts, refunds or credits for arriving late, leaving early or missing any of the activities/meals while at the DFP retreat
2. Documentary Family Photographers Retreats
2.1. Participants on a Documentary Family Photographers Retreat should be 18 or over.
2.2. An application by you for attendance on a Documentary Family Photographers Retreat may be subject to written acceptance by DFP. DFP reserves the right to refuse an application for attendance.
2.3. In order to get the most from the DFP Retreat, you should ensure you arrive on the start date and stay the duration of the retreat
2.4. Where your conduct is unacceptable (in DFP’s reasonable opinion), we reserve the right to request that you leave the Documentary Family Photographers Retreat. No refund of fees will be made.
2.5. DFP will be entitled to change the venue and make minor changes to the timing and content of any DFP Retreat. In the unlikely event we have to replace our speaker, we shall make every effort to ensure the replacement speaker has similar expertise to the one advertised.
3. Fees
3.1. Deposits are non-refundable except as set out under Refunds and Cancellations or where your application to attend a Documentary Family Photographers Retreat is not accepted by us.
3.2. Following acceptance of your application, you must pay the full amount of the fees in accordance to the payment plan before the start of the Documentary Family Photographs Retreat.
3.3. If fees are not paid by the due date, DFP will be entitled to reallocate your place. You shall remain liable for the fees although we may, at our discretion, refund you a proportion of the fees where we have been able to reallocate your place.
4. Refunds and cancellation
4.1. Due to the nature and planning of our events refunds are currently not available.
4.2. Bookings are not transferable to another date for another retreat. Your reservation is transferable if you find your own replacement for the retreat you are paid for. It is not the responsibility of DFP to find you a replacement if you can no longer attend. Payment arrangements will need to be made between you and your replacement for reservations already paid. If you are sharing a room with someone on the retreat this also applies, please find a replacement for your space once you agree with your room mate as the Retreat cost is per head and not per room.
4.3. DFP may cancel any Documentary Family Photographers Retreat at any time prior to its commencement. Except as set out in clause 4.4 below, DFP will repay any fees received from you in respect of the relevant the Documentary Family Photographers Retreat or you can transfer your booking to another DFP retreat date. Please note that DFP will not refund travel costs for cancelled Retreats.
4.4. There is no entitlement to a refund where DFP is forced to cancel part or all of a Documentary Family Photographers Retreats due to reasons beyond our reasonable control. However, refunds may be paid at DFP’s discretion.
4.5. We cannot offer refunds where we have to change speakers or venues.
5. Passport, Visa, Travel and Related Items
5.1. You are responsible for obtaining and maintaining a valid passport and all appropriate visas, permits, certificates, and/or other required documentation (“Documentation”) for the countries, jurisdictions, parks, areas, etc. you will visit during the Retreat. Company is not responsible if you are denied entry or exit to/from any country or location due to a lack of valid Documentation.
5.2. Travel Insurance. We strongly recommend the purchase of travel insurance for the Retreat. You are solely responsible for the cost of any travel insurance and ensuring that you are adequately insured for the full duration of the Retreat with respect to possible illness, injury, death, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any other potential losses, damages, costs, expenses, or liabilities (collectively “Losses”). You will be solely responsible for any Losses related to your failure to procure travel insurance. Company is not responsible for any Losses you incur and/or sustain.
6. Feedback and Complaints
6.1. Documentary Family Photographers Retreats are designed to provide an enjoyable quality experience for those attending. In the event of a complaint please make your complaint in writing and sent to hello@dfpeducation.com within 7 days of the Documentary Family Photographers Retreat ending. We take any complaint seriously and will aim to investigate and respond as quickly as possible.
7. Liability & Damages
7.1. You agree that Documentary Family Photographers Worldwide, its servants or agents will not be liable for any loss, injury or damage to any person (including Yourself) or property however caused (including by DFP or its servants or agents): (a) in any circumstances where there is no breach of a legal duty of care owed by DFP or any of its servants or agents; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury as a result of a breach of a legal duty of care owed by DFP, its servants or agents); and/or (c) to the extent that any increase in any loss or damage results from the breach by You of any of these Terms and Conditions.
For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond the DFP’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements and/or acts or regulations of national or local governments. The Promoter will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.
Documentary Family Photographers Worldwide will not have any liability to You whatsoever for loss or expenses incurred in connection with the Event or any cancellation of the Event, including, without limitation, costs of any personal travel, accommodation or hospitality arrangements made relating to the Event or the cancellation of the Event.
You agree that Documentary Family Photographers Worldwide, its servants or agents will not be liable for:
INJURY. In the event you are injured while participating in the Retreat, you agree to assume all financial obligations for any and all medical costs you incur. You acknowledge and agree that IN NO EVENT SHALL COMPANY AND/OR ANY COMPANY PARTY BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE RETREAT.
WAIVER OF LIABILITY AND RELEASE. IN CONSIDERATION FOR PARTICIPATING IN THE RETREAT, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE COMPANY, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, AND OTHER REPRESENTATIVES (EACH A “COMPANY PARTY” AND COLLECTIVELY, THE “COMPANY PARTIES”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (INCLUDING BUT NOT LIMITED TO ANY EXEMPLARY, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES, MEDICAL EXPENSES, LOST WAGES/INCOME, LOSS OF SERVICES, LOST PROFITS, PROPERTY DAMAGE, PAIN, ILLNESS, AND DEATH) (COLLECTIVELY “LIABILITIES”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE RETREAT AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY COMPANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You have been advised and urged to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the Retreat. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the Company Parties for reimbursement for any Liabilities suffered or occurring during your travel and/or participation in the Retreat.
INDEMNITY. YOU FURTHER HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS THE COMPANY PARTIES FROM ANY AND ALL LIABILITIES (INCLUDING WITHOUT LIMITATION COURT COSTS AND ATTORNEYS’ FEES) THAT ONE OR MORE OF THE COMPANY PARTIES MAY INCUR AS A RESULT OF YOUR PARTICIPATION IN THE RETREAT, WHETHER CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE (BUT EXCLUDING ANY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF A COMPANY PARTY), TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.
BINDING EFFECT. It is your express intent that this Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE any of the Company Parties.
7.2. Please ensure you take care of your personal possessions as DFP cannot accept any liability for them.
7.3. DFP will not be liable for any loss or damage suffered by you or any equipment or personal belongings brought onto the property by you resulting from any events which are beyond the reasonable control of DFP.
7.4. Subject to the above, DFP’s liability to you is limited to the fees you have actually paid for the relevant Documentary Family Photographers Retreat.
7.5 You are responsible for your allocated room during the period of the retreat. Any damage to your room or their contents incurred as a result of the acts, omissions or default on the part of you may result in a charge to remedy such damage. You will be liable for the cost of repairs carried out as a result of any damage caused to any property or equipment owned by the Venue by the negligence, wilful act or default of any such person.
8. Data
8.1. We will hold your data in accordance with DFP’s and EU's privacy policy. We will use the information you have provided to us for the purposes of contacting you with information relating to Documentary Family Photographers Retreats and to conduct analysis for the purposes of providing future Documentary Family Photographers Retreats.
9. Photography/Film Consent
9.1. The participant agrees that she/he may be photographed and/or filmed during their stay and/or activities in connection with Documentary Family Photographers Retreats and also agrees that Documentary Family Photographers Worldwide use such images and recordings for printed or digital promotion and/or advertising purposes without any prior consent. The participant may terminate this agreement at any time in written form via email. In that case, the participant's image will not be used for promotional purposes hence forward.
10. Intellectual Property Rights
You acknowledge and agree that:
10.1. all material relating to us are part of our “intellectual property rights”, which includes registered and unregistered rights in any copyright, patents, know-how, trade secrets, trademarks, trade names, design rights, get-up, database rights, and all similar rights; and
10.2. you will not, at any time, do anything that would infringe our intellectual property rights, including recording, reusing, reselling or reproducing in whole or in part any information, documents or content from the Retreat or DFP, except without our prior consent.
11. Confidential Information
11.1 . Since certain information may be disclosed by you or other participants during the Retreat, it is important, that you help us to maintain privacy and confidentiality by acknowledging and agreeing:
that the information discussed by participants during the Retreat and each Retreat is treated as private and confidential; and
not to directly or indirectly communicate or disclose (in any manner) any information relating to another participant, if disclosed within the Retreat.
12. General
12.1. The Contract contains all the terms agreed between you and DFP.
12.2. This agreement shall be governed by and construed in accordance with Irish law and the parties agree that the Irish courts shall have exclusive jurisdiction in relation to this agreement.
12.3. Terms & Conditions of booking a retreat can change at any time without notice. The current terms & conditions are always applicable.
12.4. Interpretation. You acknowledge and agree that this Agreement, including the releases and waivers of liability herein, are intended to be as broad and inclusive as permitted by applicable law.
12.5. Severability. If any portion(s) of this document is/are held by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, such portion(s) shall be interpreted and/or reformed without further action of the parties hereto to render them valid and enforceable when applied to the facts at issue and the lawfulness, validity, and enforceability of such provision(s) as applied to any other facts, and the lawfulness, validity, or enforceability of the remaining provisions of this Agreement shall in no way be affected or impaired thereby.
12.6. Waiver. The failure or delay by Company to enforce or exercise any provisions of this Agreement shall not constitute or be deemed a waiver of such provision or any other provisions herein. Furthermore, any waiver or breach of any provision of this Agreement shall not amount to a waiver of any other provision.
12.7. Headings. The headings in this Agreement are for convenience only and in no way define, limit, or describe the scope or intent of any provisions herein.
12.8. YOU ARE AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO PARTICIPATING IN THE RETREAT, AND ACKNOWLEDGE THAT THIS IS A CONSENT, RELEASE OF LIABILITY AND A WAIVER OF YOUR LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH, PROPERTY DAMAGE, OR ANY OTHER LIABILITY, WHICH CREATES A CONTRACT BETWEEN YOU AND DOCUMENTARY FAMILY PHOTOGRAPHERS WORLDWIDE. BY YOUR PURCHASE OF A TICKET TO ANY IN-PERSON EVENT, WORKSHOP OR CLASS, IT IS YOUR INTENTION TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND ANY OTHER LIABILITY UPON YOURSELF, TO THE EXCLUSION OF DFP AND ALL COMPANY PARTIES, AND TO EXEMPT COMPANY AND ALL COMPANY PARTIES FROM LIABILITY FOR, PERSONAL INJURY, PROPERTY DAMAGE, DEATH, OR ANY OTHER LIABILITIES.
